Disney Under Fire as Lawsuit Accuses Park of Safety Failures

A confrontation over one of Disney’s most basic park rules has now escalated far beyond the gates.

Smoking remains tightly controlled across Disney resorts worldwide, although individual parks take different approaches to where guests are allowed to light up. At Walt Disney World and Disneyland Resort, smoking areas have been pushed outside the theme parks entirely since 2019.

Other Disney destinations still maintain designated smoking zones inside their parks. Enforcement, however, has repeatedly proved contentious, particularly when guests ignore those boundaries and fellow visitors attempt to intervene.

Now, an incident at Shanghai Disneyland has resulted in legal action against the resort, with an injured guest accusing Disney employees of failing to respond appropriately as he was attacked.

Guest Takes Legal Action Against Shanghai Disneyland

The dispute dates back to April, when a 24-year-old guest approached another parkgoer, reportedly in his 30s, and asked him to stop smoking outside a designated smoking area near an outdoor restaurant in Shanghai Disney Resort’s Disneytown shopping and dining district.

According to City News Service, the smoker later claimed that the younger man had used an “aggressive tone.” The confrontation escalated, with the smoker attacking the guest. Video footage of the incident subsequently circulated online.

The victim, identified by Chinese media only by his surname, Zhang, was taken to hospital and treated for soft-tissue contusions.

Police later mediated the dispute between Zhang and the attacker, identified as Xu. Under the resulting agreement, Xu apologized and paid Zhang 10,000 yuan, equivalent to approximately $1,487 USD. Both men signed a formal mediation agreement.

That did not end the matter. Zhang has since turned his attention to Shanghai Disneyland, arguing that cast members should have intervened before or during the assault rather than leaving him to handle the situation himself.

“They did nothing when the conflict happened, just stood by like tourists,” Zhang said. “I had to call the police myself.”

One female cast member had allegedly already told Xu not to smoke before the confrontation began.

Zhang is now seeking a written apology from Shanghai Disneyland and asking the resort to cover his litigation costs.

He also claimed that Disney verbally apologized during pre-litigation mediation and offered several “VIP cards” as part of a proposed settlement. These would reportedly have allowed him to choose when to visit Shanghai Disneyland and receive priority access to popular attractions.

The lawsuit consequently places the focus not only on the original altercation, but also on what responsibility theme park employees have when rule-breaking between guests escalates into a physical confrontation.

Smoking Rules Have Already Caused Trouble at Disney Parks

Shanghai Disneyland permits smoking only in designated locations. These currently include areas around Mickey Avenue, Adventure Isle, Treasure Cove, Fantasyland, and the Gardens of Imagination, while additional smoking locations are available elsewhere around Shanghai Disney Resort.

As the Shanghai Disneyland website states: “With the exception of designated smoking areas, the smoking of tobacco, e-cigarettes or other products that produce a vapor or smoke is not allowed in the Park. Please refer to the Shanghai Disney Resort Official App for designated smoking locations or ask a Cast Member for assistance.”

The April attack was not the first time smoking allegedly triggered a confrontation at the resort.

In March 2025, another disagreement erupted in Shanghai Disneyland’s security line after parents asked a guest to stop smoking near children. The encounter reportedly escalated into pushing and shoving.

Shanghai Disney Resort subsequently strengthened its smoking rules in May 2025. The resort reduced the number of designated smoking areas, installed more than 2,800 “No Smoking” signs, and warned that serious violations could lead to removal, police involvement, or bans.

It remains unclear whether Xu was ultimately banned from Shanghai Disneyland following the April incident.

Smoking disputes are not limited to China. Disneyland Paris guests have repeatedly complained about visitors smoking or vaping outside the resort’s designated areas.

France also has a relatively high smoking rate. World Population Review data puts the figure at approximately 30.1%, compared with 22.6% in China, 16.4% in Japan, and 9.6% in the United States.

Disney’s American resorts take an even stricter approach inside their theme parks.

The Disney World website says: “Walt Disney World theme parks, water parks, the ESPN Wide World of Sports Complex and Disney Resort hotels are smoke-free environments except for designated smoking areas. Please note that smoking marijuana is not permitted at any time across Walt Disney World Resort, even in designated smoking areas.

During a recent visit, however, we witnessed guests apparently attempting to vape discreetly inside both Magic Kingdom and Disney’s Hollywood Studios, including around quieter sections of the parks and the outdoor queue for The Twilight Zone Tower of Terror.

Disneyland Resort similarly prohibits smoking throughout Disneyland Park, Disney California Adventure, the Esplanade, and Downtown Disney.

Its policy states, “For the comfort of all Guests, the theme parks, the Esplanade between the parks and the Downtown Disney District are smoke free. The smoking of tobacco, e-cigarettes or other products that produce a vapor or smoke is allowed only in designated outdoor smoking areas. Guests may not smoke in Disney Resort hotel rooms, on patios or balconies.”
