High Court Backs Universal Studios Controversial Ticket Ban, Update Given

Theme parks worldwide have evolved significantly over the years, with changes in policies and pricing becoming commonplace. Universal Studios Japan (USJ) has recently found itself at the center of controversy over its ticketing rules, particularly its policy banning ticket cancellations and resales. On December 19, the Osaka High Court ruled in favor of USJ, upholding the legality of the policy.

Universal Studios Japan, one of the nation’s most visited theme parks, is renowned for its attractions inspired by major film franchises. Guests flock to experience themed areas like the Wizarding World of Harry Potter, SUPER NINTENDO WORLD, and the newly launched Donkey Kong Country.

Despite the park’s popularity, USJ’s ticket policies have drawn criticism for their rigidity, especially in cases where guests are unable to cancel tickets or resell them.

USJ’s Controversial Ticket Policy

The Kansai Consumers Support Organization, a nonprofit certified by the Japanese government to protect consumer rights, challenged the policy in court. Representing consumer interests, the organization argued that the restrictions violated the Consumer Contract Act, which aims to safeguard the rights of consumers.

According to The Mainichi, the case was escalated to the Osaka High Court after a lower court also sided with USJ.

Presiding Judge Yumiko Tokuoka upheld the policy, agreeing with the earlier ruling that USJ’s terms and conditions are “reasonable” as they aim to prevent ticket price inflation. However, the high court took a nuanced approach by addressing the issue of ticket resales to third parties. While the court acknowledged that such a ban could restrict consumer rights under the Consumer Contract Act, it determined that the policy did not harm consumer interests to an extent that would render it unlawful or invalid.

The Kansai Consumers Support Organization, however, viewed the court’s recognition of restricted consumer rights as a step forward. Hirokazu Murakami, the organization’s attorney, described the ruling as a breakthrough in challenging the legality of the park’s terms.

USJ released a statement expressing satisfaction with the verdict, stating, “We believe that our claims have been upheld.” Meanwhile, consumer complaints about the inability to cancel or resell tickets continue to be reported to consumer affairs centers nationwide.

Ongoing Universal Studios Japan Closures

Beyond its ticketing policies, USJ has faced criticism over frequent and lengthy attraction closures.

Iconic rides like Jurassic Park—The Ride and Space Fantasy – The Ride remain closed for extended refurbishments, with some attractions marked for indefinite closure. Despite these challenges, the park continues to expand its offerings, with recent additions like Donkey Kong Country drawing significant attention.
