A new lawsuit has been filed against Universal Orlando by a guest who claims to have suffered severe injuries after slipping on a wet floor at the resort’s Volcano Bay water park. Joshua De La Cruz, the plaintiff, alleges that his fall occurred when he visited the restroom following a ride on the Ko’okiri Body Plunge waterslide on July 11, 2025. According to the complaint, De La Cruz asked a lifeguard for directions to the bathroom before entering the lavatory and slipping on an excessively wet floor.
De La Cruz’s lawsuit, filed on September 24, 2025, by Searcy Law, describes how he lost consciousness after hitting his head on the floor and woke up in a pool of blood. He was immediately transported to a nearby emergency room by ambulance, where doctors diagnosed him with a brain bleed.
The lawsuit accuses Universal Orlando Resort of negligence, citing a lack of safety measures in the bathroom area. Specifically, it claims the resort failed to dry the floor, provide adequate wet-floor warnings, and maintain safe conditions for guests. The complaint also suggests that other substances, such as sand and sunscreen, could have contributed to the hazardous conditions in the bathroom. The filing states, “A reasonably prudent venue would not have [a] bathroom floor that could pose a danger to its invitees.”
De La Cruz is seeking $50 million in damages, citing the physical, emotional, and financial toll the Volcano Bay incident has had on his life. The lawsuit describes ongoing medical care and treatment costs, as well as the long-term consequences of the brain injury, including pain, suffering, and loss of enjoyment of life.
Universal Orlando Resort has not commented publicly on this lawsuit. However, the Central Florida vacation destination recently settled a lawsuit involving a woman injured on the Stardust Racers ride at Universal Epic Universe. The company is also under increased scrutiny following the death of a disabled man on the same roller coaster. The man’s death was ruled an accident, but his family has retained legal counsel, and an investigation into the incident is ongoing.
